My father was coughing up blood, so we took him to the local hospital. After running some blood work that came back normal, the decided to look in his stomach. After going in there, they saw nothing. They wrote him a script for prilocet and said to take him home. Well I didn't, I took him to another hospital, they ran a catscan and found a large mass in his chest that has turned out to be cancer. I beg the other hospital to do more and they refused. They just wanted me to take him home! How can you be spitting up blood and they tell you, you are fine? i also wanted to add that like two years ago my husband went to the same hospital complaining about pain in his abdomen,they thought it might be appendicitus, they gave him a x-ray and told him he was fine. So he went back to work still hurting and 2 weeks later it was so bad he couldn't move, so I took him to another hospital and he went into surgery with in 10 minutes. He did have appendicitus but that hospital didn't run the right test for one even though that is what they thought it was.....that hospital has almost killed the 2 most important men in my life, and i want something done!
Were you in the emergency room. If so, no its not and you dont have a case. The er ruled out the emergency situation and told you to take him home and follow up with a doctor. You then should have followed up with the doctor rather than going to another emergency room. This is inapporpriate use of the er, and is why people with real emergencies end up waiting in the lobby for hours upon end.

I'd like to add to MinPin's excellent answer, that medical malpractice suits are often limited, depending on the State you live in, to 6 months time limit (or 6 months from the time of discovery of the malpractice) and a rather low dollar amount (I think in my state, CA, it is $250,000), unless actual fraud by the Drs. or nurses can be proved.

Suing the hospital will only hurt other patients there.
Write a letter to the administrators at the hospital. Ask for a change in procedures to help prevent situations like this in the future. Send a copy of the letter to a local newspaper or TV news station. That might do more good.

no i dont think its considered a malpractice suit cause he didnt die from the mass exploding or something. then you would have a case. but feel free to talk to a lawyer and see what they can do about it.

Oh yeah, you have a case involving negligence on the first hospital. Find an attorney in your local area that specializes in medical malpractice. Be sure to have the names of all persons involved for the law suit and also sue the hospital. With the evidence from the second hospital, you got the first hospital by the short hairs. Normally issues like this are settled out of court because the hospital doesn't want the publicity. The attorney will probably take 1/3 of any settlement that is agreed upon. Good luck

you can contact an attorney and as it don't always cost just to find out if it is possible to sue but in the mean time i would notify or call the hospital administrator and report what happen and how you was treated by the doctor and nurse and what their names was.

Had you taken him home and waited weeks or months to go to the other hospital, a delay that would have cost him his life, you could sue.
But you took him to another hospital right away and had him treated.
the first hospital is guilty of negligence.

Contact an attorney. You can find out by talking to a personal injury attorney if you have a case. My heart goes out to you, your father, and family. For no other reason other than these medical professionals and hospital need to be exposed for endangering his life. Something like this has happened to my best friend, and she kept telling them she hurt badly in her stomach and back and was sick. She is now fighting cancer.

You can TRY to sue, but there's only one problem:
You have to PROVE ~ and I do mean PROVE ~ your father was IRREPARABLY HARMED by the first hospital.
How was your father harmed? What harm did the hospital cause to your father that could not be repaired by someone else? Aside from having to go to another hospital ~ where you took him and he was properly diagnosed, on the same day, so there was NO DELAY IN TREATMENT --- do you see what I'm getting at? Where is the HARM? There is none.
By the time this goes to trial, and they'll probably let this one go to trial because there WAS NO HARM, your father may be cured of his Cancer, or he may die from it. Either way, it's going to take years to get to Court. You need to think about what your father's energy needs to be focused on: fighting a hospital he cannot defeat, or beating his Cancer?
I know you're angry; you have every right to be angry about the way you were treated. But the fact is the first hospital DID NOT GIVE him Cancer. HE already HAD Cancer when he went there; they simply failed to detect it. Had you taken your father home and allowed him to stay there, undiagnosed and untreated, and he'd died from that Cancer, then you'd have a case for Medical Malpractice.
Since you DID NOT follow their orders ~ since you took your father to another facility and got him properly diagnosed and treated the same day ~ THERE IS NO HARM. You cannot prove they caused you anything more than an inconvenience ~ the inconvenience of going to a second hospital.
They delayed his diagnosis by what -- a couple of hours? In the long-run, that makes no difference. Had they delayed his diagnosis by a couple of weeks, or months, or years -- that would have made a difference. But that didn't happen.
File a complaint about how you were treated; you have that right and responsibility. But you do NOT have a legal case for Medical Malpractice. I'm sorry. They did not cause permanent harm to your father. You prevented that from happening ~ thank goodness.

I work at a hospital and they have a standard protocal to follow if they think it doesn't need more investigation then they don't have to do anything else,also certain doctors are not very good or attentive. you can sue because they should have referred him to a specialist or at the very least done a cat scan them selves and kept him over night for observation. Good job on getting a second opinion. But they should have called in another doc at the first hospital when you ask for it. I hope he is okay now and good luck
