I believe it depends on whether you have any permanent/ongoing pain/disability associated with your original injury and how long you were on modified duties or seeking medical attention for this initial injury. They will definitely take into consideration your history. If you've been off 3 weeks because of the injury and reported that this is why - and that it is work-related you should definitely get workers comp benefits. I would talk directly with a claims adjudicator at your local Worker's comp branch to get further info. Good luck & hope you feel better soon!

personally i think you are entilted to it. if the co. let you go back to work you must have been cleared by the dr. so you got hurt again. re-apply, i think you will be ok.

If knee is injured at new job, don't mention pre-existing condition..

Did you file a workmans comp paper work when you were hurt? If you did and you did not settle then yes. If you didn't file the proper paper work when you were hurt then no. Good luck

I would think that if a doctor previously deemed it fully healed, then yes, you should be able to claim workers comp for it. You might have a bit of a fight about it, but there are workers comp lawyers that will handle all of that for you. At the very least I would recommend going and getting a free consultation, most lawyers will give you one.

You damn skippy! You are entitled to benefits regardless when you got hurt. The fact remains that you were injured on the job. Your company is suppose to make out an incident report and file it with their insurance company. Not only that if there is a care station in your area, you were to have an ambulance on the company's bill to take you to the nearest care station.
