OK. In June 2007 I was 8 months pregnant and fixed lunch for my little girl and I. It was Dwight Yokums chicken fries. They are supposed to be boneless. I bit into it and a bone was in it. It went between my back teeth and my whole face was swollen and black and blue. Hurt like hell! The insurance company is only offering me $400.00. That seems to be off! First off I was pregnant so I could not take any meds but tylenol and hahahh that doesnt work for something like that. Second off, it said boneless. Third my pain and suffering. What would you do? Settle and take $400.00 or wait and get more? Who would you say to get for an injury lawyer? I had called one and he doesnt want to get mixed up in this case. HELP! Thank you to all who answer. If someone does the research for me I will give ya the 10!
i think you should get the lawyer. most companies will give ppl freebies if they find somehting wrong with the product, but im guessing you won't want to eat that brand of chicken finger ever again

OK hon, I'm in Hampton, VA but I know lawyers around here, there is one really goo one called Brothers in law Huffman and Huffman. Brad and Charles Huffman. I put a link at the end. Umm, let's see, I would do it now and not wait 4 the money cuz my grandma had tried to do something like that when my grandpa got injured and the city said it didn't matter (it involved a drainage great for the city that he fell in and broke his heel, a car ran over it) I would try to sue the company. If I were you, I'd keep looking for a lawyer who will work with you on this at no charge to you unless you get a settlement. I'm pretty sure the company is in the wrong here and I doubt $400 is going to cover your medical bills. Don't settle for less than however much your medical bills add up to, and keep in mind that unless the injury is quickly and completely resolved, those bills will keep adding up in the future. Don't get greedy, but seriously....... $400? Who are they trying to kid?

Well im not a doctor nor am I qualified to make accesments so you shouldn't take any merit in my responce and should consult a doctor. Now for my responce. I have no idea what I would do, it's up to you. You might beable to get more or you might not. If you didn't have any medical bills for it, I don't think you should expect more than $400. I doubt that tylenol cost you that much.

a) For one thing, it has nothing to do with Walmart, it would be Dwight Yokums for having a mistake with their product.
b) That was a pretty dramatic thing to have happen just because there was a bone in the chicken. Without documented proof (which presumably you have?), this would be unlikely to do very well for you in court. (Besides, it's not as though you could directly prove that the bone caused whatever the problem was (even if you know it was). If someone had come to your house from the company and punched you, that would put clearer blame on the company).
I recommend just settling and being done with it.
Edit: On the lawyer note, a really expensive civil (suits) laywer could probably influence just about any claim into a win, providing the judge is in the proper mood. However, a large portion of whatever gets earned goes right to the lawyers (as it always does). It's certainly in the lawyers' interest to recommend a lawyer...
